These Terms of Service (“Terms”) govern your use of HereYou, operated via www.hereyou.ai. By using the service, you agree to these Terms. If you do not agree, please do not use HereYou.

1. Service Description

HereYou provides AI-powered emotional support conversations delivered via web-based voice technology. The service allows one person (the “gifter”) to purchase a voice conversation session for another person (the “recipient”), who receives access via SMS.

HereYou is NOT a medical service, therapy provider, counselling service, or crisis intervention service.

2. Not a Substitute for Professional Help

HereYou conversations are for emotional support and companionship only. They do not constitute medical advice, psychological counselling, diagnosis, or therapy. The AI companion is not a licensed professional.

3. Eligibility

You must be at least 18 years old to use HereYou, either as a gifter or as a recipient. By using the service, you confirm that you meet this age requirement.

4. Gift Sessions

  • Gift sessions are single-use voice conversations purchased for the price displayed at checkout.
  • Sessions are delivered to the recipient via SMS to the phone number provided by the gifter.
  • Sessions expire 7 days after purchase if unused. Expired sessions are non-refundable.
  • If a call is disconnected, the recipient may reconnect using the same session link. The conversation will resume with context from the previous call.

5. Subscriptions

  • Subscriptions provide the recipient with unlimited conversation sessions for the billing period.
  • Subscriptions are billed monthly at the price displayed at checkout and renew automatically.
  • You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
  • Subscription conversations benefit from memory continuity — the AI companion remembers context from previous sessions.

6. Payments and Refunds

  • All payments are processed securely by Stripe. We do not store your payment details.
  • Prices are displayed in USD unless otherwise indicated.
  • Refund requests for unused, non-expired gift sessions may be submitted to support@hereyou.ai within 48 hours of purchase.
  • Promotional codes and discounts are subject to their own terms and may be withdrawn at any time.

7. SMS Messaging Terms

By purchasing a gift session and providing a recipient's phone number, you confirm that:

  • You have the recipient's consent to send them an SMS on your behalf.
  • The phone number you provide is accurate and belongs to the intended recipient.

For recipients:

  • You will receive 1–3 SMS messages per gift session (session link, possible disconnection recovery, and optional follow-up).
  • Message and data rates may apply.
  • You may opt out of future messages at any time by replying STOP to any message, or by visiting the opt-out link on your session page.
  • For help, reply HELP or contact support@hereyou.ai.

8. Opt-Out

Recipients of gift sessions may opt out of receiving future gifts at any time by:

  • Replying STOP to any SMS from HereYou
  • Clicking the opt-out link on their session page
  • Contacting support@hereyou.ai

Once opted out, any future gift purchases for that phone number will be blocked and the gifter will be notified that the recipient has opted out of the service.

9. Privacy

We do not store voice recordings or word-for-word transcripts of conversations. We collect minimal data necessary to provide the service. For subscription users, AI-generated summaries of conversation themes are stored to enable continuity across sessions. See our Privacy Policy for full details.

10. Acceptable Use

You agree not to:

  • Use HereYou for any unlawful, abusive, or harmful purpose
  • Send gift sessions as a form of harassment, spam, or unwanted contact
  • Provide false information, including fake phone numbers or names
  • Attempt to reverse-engineer, exploit, or interfere with the service
  • Use the service in any way that could harm or distress others

We reserve the right to suspend or terminate access for violations of these terms.

11. Intellectual Property

All content, branding, and technology associated with HereYou are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from any part of the service without our written permission.

12. Limitation of Liability

HereYou is provided “as is” and “as available” without warranty of any kind, express or implied. To the maximum extent permitted by law:

  • We are not liable for any damages arising from use of the service, including but not limited to emotional distress, missed crisis intervention, or service interruptions.
  • Our total liability for any claim related to the service shall not exceed the amount you paid for the specific session or subscription giving rise to the claim.
  • We are not responsible for the content or quality of AI-generated responses, which may occasionally be inaccurate or unhelpful.

13. Indemnification

You agree to indemnify and hold HereYou harmless from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated “Last updated” date. Your continued use of the service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
